% 01.02.2016 By filing the present petition the petitioner has assailed award dated 04.06.2009 passed by learned Presiding Officer, Labour Court No.XVI, Karkardooma Court, Delhi in I.D. No.340/08/95. Learned counsel for the petitioner submits that the respondent Gopi Chand had expired before the impugned award was passed. Mr. Rajender Kumar Uppal, learned counsel for the petitioner seeks permission to withdraw the present petition and the application with liberty to file fresh petition after impleading the legal heirs of the deceased respondent, Gopi Chand.

With the aforesaid liberty, the petition as well as application are dismissed as withdrawn.
