% 16.12.2016 IA No. 11664/2016 (under Sec. 151 CPC by D2(a) to 2(d) This application has been filed by the defendant nos. 2(a) to 2(d) seeking return of original documents. So far certificate of sale and lease deed in respect of property bearing no.1/13, Double Storey, Tilak Nagar, Delhi and substitution of lease deed as mentioned in para 4 (v) & (vi) are concerned.

Ld counsel for the plaintiff submits that he has no objection if the same are returned as these are not the subject matter of the present suit. Ld counsel for the appellants undertakes to produce these documents as and when directed by the Hon'ble Court and he will move the application seeking to return of other original documents subject to furnishing the certified copies.

In terms of order dated 16.05.2016, since the non applicant has no objection, nor the proposed documents are subject matter of the execution of the decree, therefore, the document mentioned above, i.e. certificate of sale and lease deed in respect of property bearing no.1/13, Double Storey, Tilak Nagar, Delhi and substitution of lease deed as mentioned in para 4 (v) & (vi), be returned to the applicant on furnishing certified copies of the same.
