The present petition under Article 226 of the Constitution of India read with Section 528 of the BNSS seeks following prayers:- "a.) Issue a writ in the nature of certiorari setting aside the order passed by the jail authority vide order no. F.18/05/2023/HG/3134 dated 16.12.2024; b.) Issue a writ in the nature of mandamus directing the respondent to release the petitioner on Parole for 4 weeks for filing of Special Leave Petition before Hon'ble Supreme court and maintaining social ties c.) Pass any other order or further orders, which this Hon'ble Court deems fit and proper in the interest of justice;"

The application for parole of the present petitioner was rejected by the Competent Authority vide order dated 16.12.2024, on the basis of Rule 1210 Sub-Rule (II) of the Delhi Prison Rules, 2018, wherein it has been stated that the conduct of the petitioner for the last two years has been unsatisfactory on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. account of the punishment ticket dated 26.02.2023. It is pointed out that the same issue was taken up by the present petitioner in W.P.(CRL) 739/2023, which was decided by a Coordinate Bench of this Court on 05.02.2024, whereby the rejection of the parole application of the petitioner on the ground of unsatisfactory conduct for the past two years was upheld. It was noted that the petitioner had preferred the application for parole on 20.11.2024, which was within two years from the date of punishment ticket awarded to him on 26.02.2023.

It is pointed out that two years since the said punishment has now lapsed. In view of the same, let the present petition be treated as a fresh representation for parole and be placed before the Competent Authority. The Competent Authority shall decide the said representation within a period of 3 weeks under intimation to the petitioner.

The present petition is disposed of with the aforesaid directions. 6.
Pending application(s), if any, also stand disposed of. 7.
Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
