By way of the present petition, the petitioners are seeking quashing of the FIR bearing no. 0050/2018, registered at Police Station Safdarjung Enclave, New Delhi, for the commission of offences punishable under Sections 406/420/120B of the Indian Penal Code, 1860 (hereafter 'IPC'), and all the consequential proceedings emanating therefrom. 2.

Issue notice. The learned APP accepts notice on behalf of the State. 3.

The petitioners and respondent no. 2 to 4 are present before this Court through and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Safdarjung, Delhi. Briefly stated, facts of the present case are that the present FIR in this case was registered on the complaint of the complainant against the petitioners regarding misrepresenting and impersonating as M/s Tulsiani Constructions and Developers Ltd. The said company had approached the complainant in the year 2012 to enter into an agreement for the allotment of an apartment. During the pendency of the case, the parties have amicably settled their disputes vide Settlement Agreement dated 10.09.2021. 5.

On a query made by this Court, respondent no.2 to 4 who have been identified by the concerned IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties. Respondent no. 2 to 4 further state that they have no objection if the present FIR is quashed. 6.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 7.

Accordingly, FIR bearing no. 0050/2018, registered at Police Station Safdurganj Enclave, New Delhi, for the commission of offences punishable under Sections 406/420/120B of IPC and all consequential proceedings emanating therefrom are quashed, subject to petitioners depositing a sum of Rs.20,000/- with the Delhi High Court Advocates Welfare Fund within a period of two weeks from date.

In view of the above, the present petition, along with pending application, stands disposed of.
