I have already decided the similar issue in Basant Valabh vs. State in W.P.(CRL.) 871/2020 order dated 07.07.2020, as to if this Court can grant parole whilst the SLP is pending before the Supreme Court. Though at this stage it is submitted by the learned counsel for the petitioner the parole was granted by this Court in W.P.(CRL.)820/2020 on 22.05.2020 but, of course, the issue raised in later W.P.(CRL.)871/2020 (supra), was never raised in the W.P.(CRL.) 820/2020. Since I have passed the order dated 07.07.2020 in W.P.(CRL.) 871/2020 (supra), hence this petition is not maintainable and is accordingly dismissed.
