This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- "i) issue any appropriate writ, order or direction, directing the respondent Queen's Valley School, Phase - I, Sector 8 Dwarka, Delhi-110077 to forthwith allow petitioners, namely, Kritika Jaiswal and Aakriti Rajput in repeat in class IX under EWS category and allow them to continue their studies upto Class-XII under EWS category;

the respondents and more particularly respondent Government of NCT of Delhi to ensure that all the schools on government land strictly comply with the provision of Section 11 (3) of the Delhi Right of Children to Free and Compulsory Education Rules, 2011;..."

It is the case of the petitioners that the petitioners belong to EWS category and are students of Class IX and have been debarred from re-appearing in Class IX as they had failed in the examinations. 3.

For the said reasons, issue notice.

Ms. Sachdev, learned counsel accepts notice on behalf of respondent No. 2.

The advance copy has been supplied to the respondent No. 1, but there is nobody appearing on behalf of respondent No. 1. 6.

Ms. Sachdev, learned counsel for the respondent No. 2./ DoE states that the students are not debarred on the ground of having failed in their examinations in Class IX.

She further states that the DoE shall issue necessary instructions in this regard to respondent No. 1 school within a period of 1 week from today. 8.

Taking her statement on record and binding the respondent No. 2 to the same, the petition is disposed of.

In case there is any difficulty, the petitioners will be entitled to revive the present petition.
