% 07.03.2018 IA No.3209/2018 This application is filed on behalf of the plaintiff under section 152 CPC for amendment of the order dated 5.01.2018. It is submitted that the suit was settled amicably by the parties. It is submitted that a separate suit bearing CS(OS) No.236/2014 was settled simultaneously in which the court fees was ordered to be refunded but in the present case order qua refund of court fees could not be passed inadvertently. In the circumstances, since the matter has been settled amicably between the parties, the plaintiff shall be entitled to the refund of court fees as per the provisions of the Court Fees Act. The application is disposed of.
