By virtue of the present petition under Article 226 of Constitution of India Constitution read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks direction(s) or order(s) to the respondents to consider the case of the petitioner for premature release under the policy dated 16.07.2004 in FIR No.72/2011 dated 12.03.2011 at PS: Vivek Vihar, Delhi registered under Sections 302/392/397/411/120B/34 of the Indian Penal Code, 1860 (IPC). 2.

At the outset, learned ASC for the State submits that if the petitioner is meeting the requisite criteria applicable and is eligible for grant of premature release as per the relevant guidelines, his case shall certainly be considered in the next SRB to be held in the near future.
