O R D E R

The petitioner has filed the present petition, inter alia, praying that respondent nos.2 to 5 be restrained from harassing or torturing the petitioner. The petitioner alleges that in the first week of January, 2020 the police officials of PS Kalyanpuri visited the house of the petitioner and harassed the petitioner on the pretext of certain information regarding the whereabouts of accused Joginder @ Joga, who was wanted in connection with FIR No.533/2019 under Sections 379B/34 of the IPC registered with PS Chandni Bagh, Panipat.

The petitioner alleges that on 15.01.2020, the petitioner's brother, Gurdev Singh, was picked up by the police officials and he was released on 19.01.2020 after being tortured in order to elicit information regarding the whereabouts of his brother Aman and Joginder @ Joga. The petitioner claims that he has filed different complaints with higher authorities but no

action has been taken.

A status report had been filed, which indicates that on 17.01.2020, ASI Dilbagh from District Panipat had reported to PS Kalyanpuri in connection with investigation in respect of FIR No. 533/2019. It is stated that ASI Dilbagh was contacted telephonically and he had informed that he had visited the house of the petitioner on 17.01.2020, but had departed from there after conducting the investigation.

The concerned authorities shall make the necessary inquiries whether the petitioner's brother (Gurdev Singh) had been picked up from the petitioner's residence, as alleged. If after inquiries, it is found that the allegations are substantial, then respondents shall take necessary steps in accordance with law.

It is further directed that the respondents shall not permit any other police officer to visit the premises of the petitioner without an official from the local police station accompanying him.

The petition is disposed of in the aforesaid directions. 7.
