The present application has been moved under Section 151 of the Code of Civil Procedure, 1908 ("CPC") on behalf of the petitioner for withdrawal of the present petition.

Learned counsel for the petitioner submits that the present petition is to be withdrawn as an RFA has been filed, which was listed before the Roster Bench on 30.05.2024.

Learned counsel for respondents appears on advance notice submits that in case, the petitioner seeks to withdraw the present petition, the cost be imposed on the petitioner as respondents have been harassed by a frivolous litigation.

Learned counsel for the petitioner submits that the petition was taken up for hearing before this Court for the first time on 15.03.2024 and the respondents had put in appearance before this Court on 19.03.2024. Hence, no harassment is caused to the respondents as the present application has been moved after the 3rd date of hearing.

In view of the above, the main petition has been taken up today. 7.
