The present Petition has been filed under Section 11 of the Arbitration and Conciliation Act, 1996 ["Act"], seeking appointment of a Sole Arbitrator in terms of the Agreement dated 14.02.2014. 2.

Learned counsel appearing on behalf of the Petitioner seeks liberty to withdraw the present Petition in view of a suit presently pending, which has been preferred by the Petitioner. He submits that necessary steps shall be taken to ensure that there is no multiplicity of proceedings in respect of the disputes between the parties. 3.

Therefore, in order to ensure that there is no multiplicity of litigation, the liberty, as sought by learned counsel appearing on behalf of the Petitioner, is granted.
