Heard the learned counsel for the parties.

The petitioner filed this petition under Section 226 of the Constitution of India with the prayer to declare Regulation 6 (i)(c) of the Regulations, 2019 notified by Essential Council of Indian Medicines on 11.07.2019 as ultra vires.

The petitioner is a foundation and intends to open a Medical College for imparting education in Indian medicines system. However, there is nothing on record that the petitioner ever applied for seeking the requisite permission as per the Regulations, 2019.

On being pointed out that the petition appears to be pre-mature, learned counsel for the petitioner states that the petitioner may be permitted The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. to withdraw this writ petition with the liberty to approach the appropriate authority seeking requisite permission under the Regulations and further that in case, the permission is refused, the petitioner may be permitted to seek redressal of its grievances by instituting appropriate proceedings before an appropriate Forum/Court.

The petition is thus dismissed as withdrawn with the liberty as prayed for.
