O R D E R

By virtue of the present petition though the petitioner has sought setting aside of the impugned order dated 28.03.2022, in essence learned ASG appearing for the Directorate of Enforcement (ED) submits that the relevant part of the aforesaid impugned order for which the present petition has been filed reads is under:

"The ED has incorrectly stated in their status report dated 17.11.2021 that they informed the Swiss Authority about order dated 26.04.2021 vide aforesaid these letters. Under the facts and circumstances, ED is again directed to produce the letters/communications, in sealed cover, sent by ED to Swiss Authority, to inform about the order dated 26.04.2021 passed by this court. Considering the facts and circumstances, ED is burdened with cost of Rs.10,000/-." Learned senior counsel for the respondent, without adverting into the merits involved, submits that considering the time taken in the present proceedings he has no objection if the aforesaid paragraph is deleted as it is.

In view thereof, learned ASG fairly submits that since there is nothing remaining in the present petition, he, upon instructions from learned counsel for the ED, seeks to withdraw the present petition. 4.

The present petition is dismissed as withdrawn in the aforesaid terms.
