O R D E R

The present petition has been filed seeking issuance of writ of mandamus directing respondent no.2/National Board of Examination in Medical Sciences (NBEMS) to correct the name of petitioner in the final result from 'Sahillhan' to 'Sahil Khan' as per his documents. 2.

The case set out by petitioner in the present petition is that he completed his Master's Diploma in General Medicine from State University i.e. Uzhhorod National University, Ukraine.

After successfully completing his Master's Diploma, the petitioner applied for Foreign Medical Graduate Examination (FMGE) by submitting online form. He received an e-mail dated 28.10.2024 from respondent no.2/NBEMS, the examining body, acknowledging his form and payment towards examination fee.

Subsequently, on 17.12.2024, petitioner received an e-mail from The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

respondent no.2/NBEMS stating that it has been found that the petitioner has filled his application form with the name 'Sahillhan' whereas in the documents, his name is mentioned as 'Sahil Khan'. Accordingly, petitioner was asked to open the link provided and furnish supportive documents. 5.

Sequel to above, petitioner furnished documents to show that his name was 'Sahil Khan'. Though the petitioner had furnished documents in support of his contention that his name is Sahil Khan, which needs to be corrected, however, the petitioner received admit card which again mentioned his name as 'Sahillhan'.

In these circumstances, petitioner had no option but to go to the examination centre with the same admit card, where initially the petitioner was not allowed to sit in exam due to the reason that his name mentioned in the admit card was 'Sahillhan' and the same was not matching with the actual name 'Sahil Khan' in his I.D. proofs. The petitioner was, however, allowed to take the exam when he produced the documents and evidences that he had applied for correction of his name, which was only a typographical error.

Thereafter, the result of FMGE was declared on 19.01.2025 and the petitioner qualified the exam by scoring 166 marks out of total 300 marks. The petitioner was, however, surprised to see that despite having requested for correction of his name, the name was still incorrectly mentioned as 'Sahillhan' in his score card.

In this backdrop, the present petition has been filed seeking prayer, as noted above.

Mr. M.S. Hussain, learned counsel appearing on behalf of petitioner submits that all the documents had been furnished by the petitioner, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

therefore, respondent no.2/NBEMS ought to have corrected the name of petitioner in the score card.

Attention of the Court is invited to various documents filed by petitioner with the present petition including copies of passport, degree issued by the concerned university at Ukraine, as well as, Class X mark sheet.

It is, therefore, urged by Mr. Hussain that necessary directions may be issued to respondent no.2/NBEMS to correct the name of petitioner in the final result.

Per contra, Mr. Waize Ali Noor, learned counsel appearing on behalf of respondent no.2/NBEMS has invited attention of the Court to Clause 2.8.1 of FMGE Screening Test Information Bulletin issued by NBEMS for FMGE December 2024, to contend that it is not within the competence of respondent no.2/NBEMS to correct the name of the candidates. 13.

He submits that a limited window is provided to the candidates to correct any information except name, test city, nationality, mobile number and e-mail I.D. The said Clause 2.8.1 reads thus: "2.8.1 Edit Window: Candidates who have successfully submitted their payment for the application during Application Submission window shall only be allowed to edit their applications during 21st November 2024 to 25th November 2024. No new application can be registered or payment can be made during edit window.

Any information/document can be changed/corrected during the edit window except for Name, Test City, Nationality, Mobile Number and Email ID. Information can be edited any number of times before the closure of the window. The last submitted information will be saved in records." 14.

needs to be addressed is whether the name of petitioner can be corrected in the final result which has been issued by the respondent no.2/NBEMS. 15.

It is not in dispute that FMGE was scheduled on 12.01.2025, however, before the said date itself, respondent no.2/FMGE on 17.12.2024 had pointed out to petitioner the discrepancy in his name and also called upon the petitioner to furnish documents to substantiate the fact that his correct name is 'Sahil Khan'.

Admittedly, the petitioner had furnished various documents in support of his claim that his name is 'Sahil Khan' and not 'Sahillhan'. 17.

From the documents on record, it appears that it is only on account of typographical error that the name of petitioner has been incorrectly mentioned as 'Sahillhan' instead of 'Sahil Khan'. 18.

Having regard to the aforesaid circumstances, this Court finds that there is no impediment in correcting the name of petitioner in the final result, as well as, pass certificate.

Accordingly, respondent no.2/NBEMS is directed to correct the name of petitioner in the final result, as well as, pass certificate from 'Sahillhan' to 'Sahil Khan' as per the documents which he had furnished along with his application.
