I.A. No. 44256/2024 (Application for issuance of Court Fee refund Certificate in the name of plaintiff's counsel) 1.

The present application has been filed on behalf of the plaintiff under Section 151 of the Code of Civil Procedure, 1908 ("CPC") for issuance of Court Fees Refund Certificate in the name of plaintiff's counsel i.e., ZeusIP Advocates LLP, B-1, B Block, Sector 2, Noida, Uttar Pradesh 201301. 2.

Learned counsel appearing for the plaintiff submits that vide order dated 04th October, 2024, the suit has been decreed in favour of the plaintiff as per the agreed terms between the parties. It is submitted that this Court has also held the plaintiff to be entitled to refund of Court fees. It is submitted that the issuance of Court Fees Refund Certificate in the name of the plaintiff's counsel has been necessitated, since the plaintiff company is a company organised and existing in the United Arab Emirates ("UAE"), and does not operate in its name any bank account in India. Thus, there is no procedure for encashment of the Court Fee Refund in the United Arab Emirates from the Collector of Stamps, Delhi. Thus, the present application has been filed.

Considering the submissions made before this Court, the present application is allowed.

The Registry is directed to issue the Court Fees refund Certificate in the name of the plaintiff's counsel i.e., ZeusIP Advocates LLP, B-1, B Block, Sector 2, Noida, Uttar Pradesh 201301. 6.
