Vinayak Pg College v. National Council For Teacher Education And ORS.
$~28 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 1991/2020 VINAYAK PG COLLEGE ..... Petitioner Through:
Mr. Mayank Manish with Mr. Ravi Kant, Advocates.
versus NATIONAL COUNCIL FOR TEACHER EDUCATION AND ORS.
..... Respondents Through:
Ms. Arunima Dwivedi, Standing counsel with Ms. Niharika Rai and Ms. Ankita, Advocates.
CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 24.02.2020 1.
Issue notice to the respondents.
2.
Ms. Arunima Dwivedi accepts notice on behalf of the respondents.
3.
Ms. Dwivedi says that she will argue on the basis of the record presently available in view of the directions that I propose to pass. 4.
The substantive prayer made in the writ petition is as follows:- "A.
issue an appropriate writ[s]/direction[s] or order[s] directing the NRC/WRC to decide the application of the petitioner institution for issuance of final recognition order within a period of 5 days by giving the petitioner a reasonable time as cut off date for grant of recognition for academic session 2020-21 is 03.03.2020;"
W.P.(C) 1991/2020
5.
A perusal of the aforementioned prayers will demonstrate that according to the petitioner its application for grant of recognition for B.A. B.Ed. / B.Sc. B.Ed, four year integrated course is pending consideration.
6.
The petitioner seeks deliberation and disposal of its application before the cut off date fixed for the academic session 2020-2021. 7.
It is the petitioner's submission that it has already missed the deadline for the academic sessions 2017-18, 2018-19 and 2019-20. 8.
On the other hand, Ms. Dwivedi says that upon a show cause notice being issued by the NRC pursuant to its 311th meeting held between 16.01.2020 and 17.01.2020, the petitioner filed its reply only on 17.02.2020.
9.
Given the aforesaid circumstances, the writ petition is disposed of with a direction to the concerned Regional Committee to dispose of the petitioner's application, if possible, in the next meeting that it convenes.
10.
In view of the fact that NCTE has issued a Gazette notification dated 27.01.2020, I am told that because of the location of the petitioner, the concerned Regional Committee would be Western Regional Committee (in short "WRC").
11.
To my mind, whichever is the concerned Regional Committee, it will take decision in terms of the directions passed hereinabove. 12.
Dasti under signatures of the Court Master.
