CRL.M.C. 1027/2017 & CRL.M.A.4298/2017 This is a petition under Section 482 Cr.P.C seeking quashing of Compliant Case No.153/1/13, case titled Manoj Kumar versus Shyam Kumar & Ors., under Section 195(A)/420/511/383/389 IPC of Police Station-Vasant Vihar, Delhi and all proceedings emanating therefrom. Issue notice.
Learned APP for State and counsel for respondent No.2 accept notice. Counsel for respondent No.2 submits that he is representing respondent No.2, Mr.Manoj Kumar who has entered into settlement with the
petitioners. He further submits that he would be filing appropriate application for withdrawal of complaint case before the Court below afresh. At this stage, learned counsel for the petitioner submits that in view of the submissions made by learned counsel for respondent No.2, he wants to withdraw the present petition.
In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn. Further, counsel for respondent No.2 is at liberty to file fresh application for withdrawal of complaint case before the Court below and the Court below is directed to proceed with the matter in accordance with law.
