BAIL APPLN. 572/2019 1.

Learned counsel for the petitioner submits that by order dated 08.08.2018, Trial Court was directed to endeavour to conclude the recording of the prosecution witnesses within six months, however, till date prosecution evidence has not concluded and only three witnesses have been examined thereafter.

Learned APP informs that 35 witnesses still remain to be examined.

Learned counsel for the petitioner submits that in case directions are issued for expeditious disposal of the petition, he would BAIL APPLN. 572/2019

not press his petition at this stage.

Keeping in view the directions issued vide order dated 08.08.2018 and after perusal of the order sheet of the Trial Court, Trial Court is directed to expedite recording of the prosecution witnesses and endeavour to conclude the same preferably on day to day basis. Trial Court along with the public witnesses shall also summon the official witnesses so that time of the Court does not go waste in case some witness is not present in Court. 5.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition.

Petition is accordingly dismissed as withdrawn with the aforesaid directions.
