Vide judgment dated 31st August, 2015 in W.P.(C)11487/2009, the Court remanded back the matter to the disciplinary authority to give a tentative note of disagreement, call for a representation from the petitioner and thereafter, pass a fresh order after considering the same. The Court further directed the petitioner to be reinstated with backwages. 2.

Learned ASG submits that the petitioner was reinstated with backwages on 6th April, 2016 in terms of the order dated 29th March, 2016. It is further submitted that the note of disagreement was issued on 5th May, 2016 to which the petitioner has filed the response on 23rd May, 2016. Learned ASG further submits that the final order has been passed by the disciplinary authority on 28th May, 2016. Copy of the same is served on learned counsel for the petitioner in Court.

Learned counsel for the petitioner submits that the note of disagreement is not in terms of the order dated 31st August, 2015. Learned

counsel for the petitioner submits that full backwages have also not been paid to him which is disputed by learned ASG. 4.

The petition is disposed of with liberty to the petitioner to avail appropriate remedies available to him in respect of his grievances in accordance with the law.

Copy of this order be given dasti to counsel for the parties under the signature of the Court Master.
