O R D E R

This petition under Section 29A of the Arbitration and Conciliation Act, 1996, has been filed seeking extension of the mandate of the learned Arbitral Tribunal, which is in seisin of disputes between the parties under four contracts for the supply and installation of Coal Handling Plant Package.

The mandate of the learned Arbitral Tribunal has been extended from time to time, lastly by an order of this Court dated 19.01.2024 in O.M.P. (MISC) COMM.) 42/2024 until 14.03.2024. However, in the interregnum, one of the learned Arbitrators unfortunately passed away on 26.01.2024 while the award was reserved. A substitute Arbitrator was nominated on 26.02.2024 and the Arbitral Tribunal stands reconstituted w.e.f. 29.02.2024. The re-constituted Arbitral Tribunal is to hear final arguments again and then render the award.

mandate for a period of six months from 14.03.2023, learned counsel for the parties jointly submit that the extension may be granted for a period of nine months from 14.03.2024.

With the consent of learned counsel for the parties, the petition is allowed and the mandate of the learned Arbitral Tribunal is extended for a period of nine months w.e.f. 14.03.2024.

The petition, alongwith pending application, stands disposed of in these terms.
