By way of this petition, the petitioner challenges an order dated 10.02.2026 passed by the Sessions Court in Crl. Appeal No. 316/2025. By the said order, the Court allowed an application filed by respondent No. 2 herein for condonation of a delay of 87 days in filing an appeal against conviction under Section 138 of the Negotiable Instruments Act, 1881.

After some arguments, Mr. Manmohan Singh, learned counsel for the petitioner, submits, upon instructions from the petitioner, who is present in Court, that he does not press this petition, without prejudice to the rights and contentions of the petitioner in the pending appeal. 3.

The petition, alongwith the pending applications, is dismissed as withdrawn, in terms of the above submissions. 4.

It is clarified that this Court has not expressed any opinion on the merits of the case.
