O R D E R

% 04.05.2026 CRL.M.A. 13704/2026 (for early hearing) The petitioner has filed this application for early hearing of the captioned petition on the ground of settlement between the parties. The parties are both present and are represented by counsel. With their consent, the application is allowed and the petition is taken up on Board.

By way of the present petition under Article 226 of the Constitution, the petitioner assails the order dated 20.02.2025, whereby the maintainability of a complaint filed by the respondent under the Domestic Violence Act, 2005, was upheld by the learned Magistrate's The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Court, as well as the order dated 14.03.2026, whereby the learned Sessions Court dismissed the revision petition filed against the order dated 20.02.2025.

During the pendency of the present petition, the petitioner and the respondent have amicably settled their disputes and entered into a Memorandum of Understanding ["MoU"] dated 28.04.2026, a copy whereof has been placed on record alongwith CRL.M.A. No. 13704/2026. The settlement contemplates payment of a total sum of Rs. 12,00,000/- by the petitioner in favour of the daughter of the respondent in three tranches. The first tranche of Rs. 5,00,000/- was paid upon execution of the MoU, the second tranche of Rs. 5,00,000/- is to be paid upon withdrawal of the present petition filed by the petitioner and CRL.REV.P. No. 1207/2023 filed by the respondent. 3.

Mr. Nitesh Gupta, learned counsel for the petitioner, has handed over a demand draft of Rs. 5,00,000/- to Ms. Deeksha Sharma, learned counsel for the respondent, and seeks permission to withdraw the present petition.

Ms. Sharma, on instructions from the respondent, who is present in Court, undertakes that CRL.REV.P. 1207/2023, which is listed before a coordinate Bench of this Court today, will also be withdrawn with the permission of the Court.

The final tranche of Rs. 2,00,000/- is to be paid upon the respondent withdrawing proceedings under the Domestic Violence Act, out of which the present petition arises.

Having regard to the aforesaid settlement, Mr. Gupta seeks permission to withdraw this petition.

The petition, alongwith the pending applications, is dismissed as withdrawn in terms of the settlement.
