O R D E R

The petitioners seek quashing of FIR No.263/2004 under Section 63 of the Copyright Act, 1957 Police Station Krishna Nagar, based on a settlement.

As per the subject FIR, apart from the petitioners, another accused Mr. Raju Kohli, s/o Sh. Chet Ram is also an accused. Learned counsel for the parties submit that the disputes have been settled only qua the present petitioners and no settlement has taken place with Mr. Raju Kohli, s/o Sh. Chet Ram.

Mr. S.K. Gulati, authorised representative of respondent No.2 Company is present in person and has produced the letter of authority dated 09.05.2018. The same is taken on record. He submits that the respondent No.2 Company has decided to settle with the petitioners CRL.M.C. 316/2018

and the respondent No.2 has no objection to quashing of the subject FIR.

In view of the above and keeping in view of the fact that the parties have resolved their dispute and further that the respondent No.2 Company does not wish to press its complaint against the petitioners, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly, the petition is allowed qua the petitioners. FIR No.263/2004 under Section 63 of the Copyright Act, 1957 Police Station Krishna Nagar and the consequent proceedings emanating therefrom are hereby quashed qua the petitioner. 6.

This is without prejudice to the proceedings pending against Mr. Raju Kohli, s/o Sh. Chet Ram.
