% 18.01.2017 Crl.M.A. 937/2017 Exemption allowed subject to just exceptions. BAIL APPLN. 94/2017 Notice. Learned APP for the State accepts notice. By this application the petitioner seeks interim bail on the ground that he has to apply for the admission of the minor child Arnav in the school. Learned APP for the State on instructions from the investigating officer states that the fact that petitioner has a child aged 3 and a half years has been verified, however he states that the grand-mother of the child can take care of the admission process.

The above-noted FIR was registered pursuant to the death of the petitioner under Section 498A/ 304B /34 IPC. It is thus apparent that the minor child Arnav has no mother and in case proper formalities are not complied with at the time of admission, he would not be able to get admission in a proper school. Thus release of the petitioner for this purpose is essential.

Considering the facts and circumstances of the case, the petitioner is directed to be released on interim bail for a period of two weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the learned Trial Court/ Duty Magistrate.

Application is disposed of. Order dasti.
