% 25.02.2020 This writ petition is filed by the petitioner seeking an appropriate direction prohibiting respondent No.1/SDMC from taking any action to demolish the Masjid, Madarsa and residence of the petitioner and also a direction to respondent No.1/SDMC to give an opportunity of hearing to the petitioner before taking any action.
Learned counsel appearing for respondent No.1/SDMC submits that a complaint had been received regarding unauthorised construction being carried out by the petitioner on the property in question. He also states that, for the time being, there is no intent to demolish the Masjid, Madarsa and residence of the petitioner.
A similar submission has also been made by the learned counsel
appearing for respondent No.2/L&DO.
The above submissions are taken on record, subject to the petitioner filing an affidavit stating that he will not carry out any additional construction on the property in question. Affidavit will be filed within two weeks from today with an advance copy to the learned counsel for respondent No.1/SDMC and learned counsel for R-2/L&DO. With the above direction, the present petition is disposed of. All pending applications, if any, are also disposed of. JAYANT NATH, J.
