% 10.11.2017 IA No. 13166/2017 This application is filed under Order 23 Rule 3 & 3A CPC for taking on record the settlement entered into between the parties and passing of a decree as contained in para 2 of the settlement. The terms and conditions of the settlement between the parties who are related to each other have been stated in para 2 of the application. The terms of the settlement are legal.

Accordingly, the application is allowed.

CS(OS) 226/2014 and IA Nos. 1545-46/2014, 12523/2017 In view of the above, the suit is disposed of A decree is passed in terms of para 2 of the application i.e. IA No.13166/2017. Pending applications also stand disposed of. In terms of Section 16A of the Court fees Act, the plaintiffs shall be entitled to refund of 50% of Court Fees.
