Crl. M.A. No. 3627/2017 Issue notice. Notice is accepted on behalf of the State by Mr. Mukesh Kumar. Counsel respondent nos.2 to 4 as well as respondent nos.5 to 7 accepts notice. The petitioner has preferred the present transfer petition to seek the consolidation of CC No.99/1/2015 titled Suresh Kumar Khera v. Darshan Singh; CC No.150/1/15 titled Darshan Singh v. Suresh Kumar
Khera along with an application u/s 195/340 Cr PC pending in the court of Sh. Ankit Singla, Saket Courts with CC No.171/1/15 titled Suresh Kumar Khera v. Avtar Singh; CC No.176/15 Avtar Singh v. Suresh Kumar Khera (along with an application u/s 195/340 Cr PC) pending in the court of Shilpi Jain, Tis Hazari Courts and CC 138/1/16 titled Suresh Kumar Khera v. Darshan Singh pending in the court of Anuj Aggarwal, Saket Courts. In respect of the last of the aforesaid cases, Crl. M.A. No. 3627/2017 has been moved, since it did not form part of the original petition. Learned counsel for respondent nos.2 to 4 and respondent nos.
5 to 7, who are also embroiled in the disputes between the parties and are complainant or accused in the aforesaid cases, also join the same prayer that all the aforesaid cases be tried by the same court since they involve the same set of parties and the disputes arise in relation to the same subject matter. It is submitted that it shall lead to general convenience of the parties if all the aforesaid cases and application are taken up by the same court. Since the property in disputes falls within the jurisdiction of District South, Saket Courts, all the aforesaid cases are directed to be clubbed and heard by the same learned MM at District South, Saket Courts. The parties shall appear before the CMM concerned on 29.03.2017 at 2:00 p.m. for assignment of the competent court.
Petition and application stands disposed of.
