Learned Addl. P.P. for the State submits that the Investigating Officer is present along with the mother of child-victim. 2.
The custody of the child-victim was given to her mother but fact remains that the child victim is now in Kasturba Gandhi Trust, Bakhtawarpur, Delhi as she is not interested in living with her mother. She has been sent to the abovesaid Trust as per the order of Child Welfare Committee (CWC).

Learned Addl. P.P. for the State submits that investigation is on its last leg and charge-sheet would be filed very shortly. He also submits that a totally different version has been given by the child-victim in her statement under Section 183 BNSS.

After hearing arguments for some time, learned counsel for the applicant, without prejudice to his rights and contentions, and, on instructions, seeks to withdraw the present application, with liberty to file application afresh once the charge-sheet is filed. 5.
The application is, accordingly, disposed of, as not pressed. 6.
Liberty, as prayed, is granted.
