% 10.06.2020 The applicant, who is an undertrial in case arising from FIR No. 78/2017 registered under section 21 NDPS Act at PS: Special Cell (SB), seeks regular bail.

Latest nominal roll dated 08.06.2020 in respect of the applicant has been filed. It shows that the applicant has been in judicial custody for about 02 years and 07 months.

In the status report, the State alleges that a quantity of about 1.1 kg of heroin was recovered from the applicant.

Mr. Tarang Srivastava, learned APP for the State submits that out of 22 prosecution witnesses, 14 witnesses have been examined and 8 witnesses remain for deposition ; and that the trial would be concluded soon.

In the circumstances, after making some submissions, Ms. Rashmi Kaushik, learned counsel appearing for the applicant states that she would wish to withdraw the present bail application, with liberty to file a fresh application at an appropriate stage.

The application is accordingly dismissed as withdrawn, with liberty as prayed for.
