..... Petitioners Through :

versus NATIONAL COUNCIL FOR TEACHER EDUCATION AND ANR.

..... Respondents Through :

Ms. Arunima Dwivedi, Standing Counsel with Ms. Niharika Rai and Ms. Ankita, Advs. for NCTE.

CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 24.02.2020 CM No.7240/2020 1.

Allowed, subject to just exceptions.

W.P.(C) 2067/2020 2.

For the moment, the limited grievance of the petitioners is that despite a remand order being passed by the Appeal Committee of the NCTE as far back as on 07.06.2018, there has been no movement in the petitioners' matter.

3.

Mr. Amitesh Kumar submits that the Northern Regional Committee (NRC) in its 288th meeting held between 05.09.2018 and 07.09.2018 decided W.P.(C) 2067/2020

to constitute a Visiting Team (VT) to ascertain and scrutinize the essential documents such as land documents/building plan, CLU, BCC, NonEncumbrance Certificate and other requisite documents insofar as their authenticity was concerned.

4.

Mr. Amitesh Kumar says that the VT visited the petitioners' facilities on 30.10.2018.

5.

It is further stated by Mr. Amitesh Kumar that pursuant to the inspection conducted by VT, a report has been generated, although, a copy of the same has not been furnished to the petitioners. 6.

The petitioners are aggrieved by the fact that after the 288th meeting, NRC has convened 25 meetings and in none of the meetings their case has been considered.

7.

Issue notice to the respondents.

8.

Ms. Arunima Dwivedi accepts notice on behalf of the respondents. 9.

Since the petitioners seek a limited direction of consideration of their case, the captioned writ petition is disposed of with a direction to the respondents that the petitioners case be considered (if not already considered), in the next meeting of the concerned regional committee i.e. NRC/WRC, as the case may be, which is slated to commence from 25.02.2020.
