The present petition under Article 226 of the Constitution of India read with Section 482 of the Cr.P.C. seeks the following prayers:- "(a) Declare the act of freezing the account of the Petitioner by the Respondent as illegal, arbitrary and unconstitutional, and further issue directions to the Respondent to de-freeze the bank account of the Petitioner subject to taking bank guarantee; and/or ( b) issue suitable directions, orders as are deemed necessary in the facts and circumstances of the case.

AND FOR THIS ACT OF KINDNESS, THE PETITIONER / APPLICANT / NOTICEE / ACCUSED SHALL AS DUTY BOUND EVER PRAY:"

submits that approximately Rs. 95 lakhs is being presently investigated qua the present petitioner's account. It is submitted that subject to freezing an amount of Rs. 95 lakhs in the account of the petitioner, the latter will be permitted to operate his account at this stage. 3.

In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to file a fresh, if the need so arises.

The petition is dismissed as withdrawn and disposed of accordingly in the aforesaid terms.
