% 23.01.2017 CM No.2897/2017 (exemption) Allowed subject to all just exceptions.

C.R.P. 16/2017 &CM No.2897/2017(stay) The learned counsel for the petitioner, after making some submissions, requests that the amount which has been directed to be deposited by the petitioner may be permitted to be deposited in three instalments.

The respondent has filed the summary suit for recovery of Rs.11,15,472/-.

The trial court by the impugned order granted conditional leave to defend to the petitioner subject to deposit of Rs.5 lacs in the form of FDR. The learned counsel for the petitioner submits that the financial conditions of the petitioner are very bad and requests for some

accommodation on that account.

Subject to the petitioner depositing a sum of Rs.2 lacs within two weeks from today, the petitioner would be entitled to proceed with the matter. The balance of sum of Rs.3 lacs may deposited in two instalments of three months each. Payment will be made as directed by the trial court. With the above directions, the present petition and all the pending applications are disposed of.

A copy of this order be given dasti under the signature of the court master to the petitioner.
