The present petition has been filed by the Petitioner - Vinod Kumar Navrathnmal under Article 226 of the Constitution of India seeking issuance of appropriate writ challenging the detention of gold Kada, which was seized by the Customs Department on 27th June, 2024. 3.

The case of the Petitioner is that he arrived at the Terminal-3, IGI Airport, New Delhi on 27th June, 2024 from Hong Kong. The Customs Department detained the gold Kada belonging to the Petitioner, weighing 44 grams vide detention receipt no. 4714. Appraisal of the Kada was also done. According to the Petitioner, no show cause notice was issued, hence, it is prayed that the goods be released.

In view thereof, the ld. Counsel for the Petitioner seeks permission to withdraw the present petition with liberty to avail remedies in accordance with law by filing an appeal against the said order. 6.

Since the order has been received today, the Petitioner is free to file an appeal in terms of the limitation prescribed in the Limitation Act, 1963, which shall be calculated from today.

Accordingly, the petition is dismissed as withdrawn with liberty as prayed for.
