Jarnail Singh Sodhi v. State ( NCT Of Delhi) & ANR
$~20 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(CRL) 706/2019 JARNAIL SINGH SODHI ..... Petitioner Through:
Mr Sunil Kumar, Advocate.
versus STATE ( NCT OF DELHI) & ANR ..... Respondents Through:
Mr Sanjay Lao, ASC for State with SI Ali Akram, PS Rajinder Nagar.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 08.01.2020 1.
The petitioner has filed the present petition, inter alia, praying that investigation in relation to FIR No.0216/2018 under Sections 306/34 of the IPC registered with PS Rajinder Nagar be transferred to CBI or any independent agency.
2.
The said FIR was registered at the instance of the petitioner, who is the father of the deceased. The petitioner's son had committed suicide on 06.06.2018. A suicide note and pen drive was recovered from the pocket of the deceased.
In his suicide note, the deceased had stated that he was depressed and had been tortured for the past four or five years due to personal relations with another girl (name withheld to avoid ignominy). A plain reading of the suicide note does not indicate any culpability on the part of the said girl.
Nonetheless, the petitioner insists that the said girl had abetted his son's suicide.
3.
The petitioner has filed the present petition alleging that the investigation has not been carried out in a proper manner. He alleges that WhatsApp messages from the phone of the petitioner's son were deleted, while the phone was in custody of the Investigating Officer. 4.
Mr Lao, learned ASC appearing for the State states that the said allegation is without basis and none of the evidence has been tampered with. Nonetheless, he submits that he has no objection if the investigation is transferred.
5.
In view of the above and to obviate any further allegations, this Court considers it apposite to direct that further investigation be transferred to the DIU/Central District.
The Commissioner of Police is directed to issue necessary directions for transferring the investigation, as directed above. 6.
The petition is disposed of with the aforesaid directions. 7.
