The present writ petition has been filed seeking a direction to respondent-MCD to take action against the unauthorised construction on the first floor, second floor and the third floor of DDA LIG Flat No.A-5B/96B, Janakpuri, New Delhi, being carried out by respondent No.2. 2.

Mr. Kapil Dutta, standing counsel appearing on behalf of respondentMCD on advance notice, submits that demolition order was passed against the subject property by MCD on 24th July, 2025. Against the said order, the respondent no.2 had filed an appeal before the appellate Tribunal, MCD ('ATMCD'), being Appeal No.316/2026 titled as Geerish Ahuja @ Raju v. MCD, wherein, an interim protection has been granted in favour of respondent no.2.
