The present writ petition has been filed seeking a direction to the respondent-MCD to take action against the unauthorized construction carried out in the property bearing no. F-22, Upper Anand Parbat, New Delhi (hereinafter the 'subject property').

Status report has been filed on behalf of the respondent-MCD, on 13th April, 2026, wherein it is stated as under:

i. There is no sanctioned building plan in respect of the subject property. ii. Unauthorized construction was noticed on the third floor of the subject property and hence, a work stop notice has been issued on 13th March, 2026 to the concerned SHO, P.S.: Anand Parbat. iii. Subsequently, a show cause notice has also been issued to the owners/ W.P.(C) 4399/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. occupiers of the ground floor, first floor, second floor and third floor of the subject property on 6th April, 2026.

Counsel appearing on behalf of the respondent nos. 4, 5 and 6 submits that they are not carrying out any unauthorized construction. 4.

Taking into account the status report filed on behalf of the respondent-MCD, MCD shall take appropriate action in accordance with law in respect of the unauthorized construction being carried out on the third floor of the subject property.

The respondent no. 3/SHO, P.S.: Anand Parbat shall ensure that no unauthorized construction is carried out in terms of the work stop notice, issued by the respondent-MCD.

Insofar as the show cause notice issued in respect of ground floor, first floor and second floor of the subject property, appropriate action shall be taken by the respondent-MCD in accordance with law after giving an opportunity of hearing to the parties.

The present writ petition alongwith the present application stands disposed of in light of the aforesaid directions. 8.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

Needless to state, all rights, contentions and legal remedies of the parties are kept open.
