The present writ petition has been filed seeking a direction to the respondent no.1/MCD to demolish the unauthorised construction carried out by the private respondent no.3, at the property bearing no. 155 Sarai Jullena, New Friends Colony, New Delhi:110025, and property bearing No. 135 Sarai Jullena, New Friends Colony, New Delhi: 110025. 2.
The petitioner is the owner of the property bearing no.153 G/F Sarai Julaina New Friends Colony. It is contended on behalf of the petitioner that the private respondent no.3 has encroached upon the public road and has covered the footpath.

Despite various complaints made by the petitioner to the respondentsMCD and SHO Police Station, New Friends Colony, New Delhi-l10019, no action has been taken by the said authorities. Mr. Shivam Sachdeva, counsel appearing on behalf of the respondent no.1/MCD, has handed over the current photographs dated 2nd April, 2026 and 6th April, 2026 to show that currently, there is no unauthorised encroachment on the public footpath.

The aforesaid photographs are taken on record. 5.
In view thereof, the grievance of the petitioner stands redressed. 6.
The petition stands disposed of, with liberty to the petitioner to take appropriate remedies, in accordance with law. 7.
All rights, contentions and legal remedies of the owner/occupier/private respondent are kept open.
