The Petitioners- Mr. Subhash Chand and Mr. Sunil Marwah have filed the present petition under Article 226 and 227 of the Constitution of India, inter alia, seeking transfer of membership in their name in the Naveen City CGHS Ltd. (hereinafter, 'Society'). The grievance of the Petitioners is that the Petitioners had fulfilled all the formalities for transfer of membership and filed the application on 18th November, 2025, however, the said application has not been decided by the Registrar Cooperative Societies (hereinafter, 'RCS').

As per the Petitioners, the original member of the Society was Ms. Asha Sehgal who had transferred the interest in Flat No. 22 in the Society to Ms. Saroj Bhayana. The possession of the said flat was given to Ms. Saroj Bhayana on 15th February, 1996.

The Petitioner No. 1- Subhash Chand had purchased the flat from Ms. Saroj Bhayana and later on transferred the same name to his wife namely, Smt. Kusum Marwah. dated 18th April, 2024 are relied upon by the Petitioners. 5.

Smt. Kusum Marwah had passed away on 27th January, 2025 and had left behind Petitioner No. 1-Subhash Chand and her son, Petitioner No. 2- Mr. Sunil Marwah as the legal heirs.

It is in this background that the application for membership of the Society has been filed by the Petitioners along with the documents including death certificate, the survivor certificate etc. The prayer of the Petitioners is for early disposal of the said application/representation. 7.

Heard. The issue involved is a short one. The RCS has to merely verify the documentation filed and allow the transfer of membership. Accordingly, let the the RCS take a decision on the application/representation filed by the Petitioners within a period for three months after affording a personal hearing to the Petitioners. An officer bearer of the Society shall also be heard by the RCS before passing the final order.

The order shall be communicated to the Petitioner by the RCS by 15th July, 2026.

Let the Petitioners and the office bearer of the Society appear before the RCS along with the requisite records on 7th May, 2026 at 11:30 AM. 10.

Petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
