CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 08.03.2019 Notice. Learned APP accepts notice for respondent no. 1. Respondent no.2-Smt. Renu is present in Court along with her counsel, who accepts notice.
Respondent no.2 has been identified by SI Raju Yadav of police station Sultan Puri.
It is submitted that petitioner no.1 (husband) and respondent no. 2 (wife) have settled their disputes amicably and started living together for the last more than three months. Respondent no.2 submits that presently she has no grievance against petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3, therefore, she is not interested in pursuing the FIR No. 385/2012 under Sections 498-A/406/34 IPC registered at police station Sultan Puri and
the same may be quashed.
Affidavit of respondent no.2 to this effect is already on record.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
