The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce Ms. Nidhi @ Nazia.

before us in person. We have interacted with her in detail. We have also interacted with the petitioner. Ms. Nazia has stated that she wishes to go along with the petitioner and reside with him. From the interaction, we could also gather that she apprehends that her decision will not be accepted by her family members and that she feels threatened by them.

Accordingly, we direct that the mobile numbers of the SHO and the Beat Constable of the area where the petitioner resides, shall be shared with the petitioner and Ms. Nazia. In the event of any interference by the family of Ms. Nazia or any threat from them, the petitioner and Ms. Nazia shall be at liberty to seek protection from the SHO/Beat Constable, who shall take immediate action on the same. 4.
