O R D E R

This order is in continuation of the earlier orders dated 15th & 28th January, 2016 and 2nd February, 2016.

The counsel for the respondent New Delhi Municipal Council (NDMC) under instructions from Mr. Anand Tigga, Assistant Architect, NDMC present in Court states that the plan showing the location where the petitioner can construct two toilets and the dimensions of the two toilets is being handed over to the counsel for the petitioner in Court. It is further stated that though the height of the toilets is not mentioned in the said plan, but the petitioner may restrict the height to that permissible in law i.e. minimum of 9 feet and not more than 12 feet.

The petition is disposed of with liberty to the petitioner to at his own cost re-construct the toilets at the location and as per the dimensions indicated in the site plan handed over in the Court and in accordance with the height as recorded above and with a direction to not use the construction so made for any other purpose and not to raise any additional construction in the garb of the construction of the toilets.

The officials of the respondent NDMC to from time to time inspect the premises to ensure compliance of this order. RAJIV SAHAI ENDLAW, J.
