The present writ petition has been filed seeking direction to respondent no.1/ MCD to take necessary action in respect of unauthorized construction done by respondent no.3 in the shape of fourth floor and fifth floor at the property bearing no.C-3/309, Janakpuri, New Delhi - 110058 (hereinafter 'subject property').

Status report has been filed on behalf of respondent no.1/ MCD, wherein it is stated that the building plan in respect of the subject property has been sanctioned for construction of stilt, ground floor, first floor, second floor and third floor for residential use.

It is further stated in the said report that the subject property was W.P.(C) 4413/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 30/04/2026 at 13:39:45
inspected on 2nd April, 2026 and it was noticed that unauthorized construction had been carried out in stilt, ground floor, first floor, second floor and third floor of the subject property, and part fourth floor had been constructed unlawfully. Accordingly, a show cause notice has been issued on 2nd April, 2026.

Taking note of the aforesaid submissions, the present writ petition is disposed of while directing respondent no.1/ MCD to take action in accordance with law, in an expeditious manner. 5.
In the event the petitioner has any further grievance with regard to the unauthorised construction, she is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the respondent no.3/ owner/ occupier shall remain protected.
