The present application under Section 439 of the Cr.P.C. seeks regular bail in case FIR No. 677/2016, under Sections 302/201/202/34 of the IPC, registered at P.S. Tilak Nagar.

Learned APP for the State, on instructions from the Investigating Officer, submits that trial in the present FIR is near completion and out of a total 37 witnesses, 33 have already been examined. 3.

Learned counsel appearing on behalf of the applicant, without prejudice to his rights and contentions of the latter, seeks leave to withdraw the present application seeking directions for an expeditious trial. 4.

Leave granted.
