The petitioner contends that he is a partner of M/s Cafe Kubana. The petitioner had the license for L18 and L18f (service of Wine, Beer and Alco Pop and Foreign Wine, Beear and Alcopop in independent restaurant). He prays for the following reliefs:

"a) Issue writ of MANDAMUS or any other appropriate writ, order or directions thereby directing the respondent No.1 to permit the petitioner to deposit renewal of license fees and continue with liquor license till the outcome of FIR No.511 of 2025 lodged by respondent No.2. b) Any other or further order which this Hon'ble court may deem fit and proper be passed on the present facts and circumstances of the case in the interest and furtherance of Justice."

Ms. Avni Singh, learned counsel for the respondents, who appears on advance instructions, submits that on account of lodging of a First Information Report (FIR), the Excise Department had received a communication from the Commissioner of Police for taking appropriate action. However, before action could be taken, the license had already been expired. She submits that the petitioner will have to apply for a fresh license under Rule 41 of the Delhi Excise Rules, 2010. The same shall be considered in accordance with law.

Accordingly, let the petitioner to do the needful. If the petitioner's grievance is not mitigated, he shall be at liberty to take appropriate recourse in accordance with law.
