This is a petition seeking execution of the award dated 16.11.2021. 2.

Admittedly, the award dated 16.11.2021 has been set aside in OMP (COMM.) 181/2022 vide judgment dated 18.12.2023. 3.

The learned counsel for the decree holder states that an appeal has been filed and is likely to be listed soon.

The fact remains that as of today, there is no award existing in the eyes of law which is to be executed.

For the said reasons, the petition has become infructuous and is accordingly disposed of.

In case the judgment dated 18.12.2023 is varied/modified/set aside, the decree holder is at liberty to take appropriate steps including reviving of the execution petition.
