W.P.(C) 574/2018 The present writ petition under Article 226 of Constitution of India has been filed by one of legal heir of Late Shri Krishan, who expired on 30.07.2017, seeking a direction to the MCD to transfer the Tehbazari rights in his favour. Mr.Kashyap fairly admits that no representation has been made to NDMC seeking such transfer. He also admits that there is a dispute between the legal heirs, which has not yet been resolved.
In the absence of any representation having been made to the NDMC post the death of Shri Krishan prior to appearing this Court, we find the present writ petition to be misconceived.
Dismissed accordingly.
