This hearing has been done through hybrid mode. 2.
The present petition under Section 25-B(8) of the Delhi Rent Control Act, 1958, seeks the following prayers:- "i. Call the records of Eviction Petition No. E-1l8/2025 (RC ARC No. 401/2025) titled as Satish Chand Rastogi Vs M/s United Radio Agencies through its proprietor Sh. Vinod Mulchandani decided on 09.01.2026 by Ms. Divya Gupta, Ld. Additional Rent Controller - 02 (Central), Tis Hazari Courts, Delhi;
ii. Set aside the impugned eviction order dated 09.01.2026 passed by Ms. Divya Gupta, Ld. Additional Rent Controller -02 (Central), Tis Hazari Courts, Delhi and grant necessary leave to defend to the petitioner for contesting the eviction petition on merits, in order to meet the ends of justice;
iii. Pass any other or further order which this Hon'ble Court deems proper in the facts and circumstances of the case, in favor of the petitioner and against the respondent."

On 06.04.2025, this Court passed the following order: - "4. Learned counsel for the petitioner, on instructions from the latter, submits that he shall vacate the subject premises on or before 30.09.2026. Let an affidavit of undertaking be placed on record before the next date of hearing."

In pursuance of the aforesaid direction, an affidavit of undertaking dated 04.05.2026 has been placed on record on behalf of the petitioner wherein, it has been stated as under: - "3.
That in compliance with the aforesaid order, I undertake to hand over peaceful and vacant possession of the premises bearing Municipal No. 1681, Shop No. 5, Ground Floor, Mangal Market Bhagirath Place, Delhi - 110006 to the Respondent on or before 30.09.2026."

In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave granted.

The present petition is dismissed as withdrawn and disposed of. 8.
Needless to state that the petitioner shall abide by the aforesaid affidavit of undertaking given before this Court.
