% 20.01.2020 This writ petition is filed by the petitioner seeking demolition of the illegal structure raised by respondents No.1 to 3 in House Nos.3206, 3207 and 3213, Ranjit Nagar, New Delhi- 110008.

The case of the petitioner is that an open piece of land was leased out to the grander father of respondents No.1 and 2 where they have constructed upto the ground floor. In 2017, respondents No.1 and 2 raised illegal and unauthorised construction on the first and second floor, which is continuing today.

North DMC has filed a status report on 27.02.2019, which states that the property bearing No.3213, Ranjit Nagar, New Delhi is constructed without sanctioned building plan and action has been taken against the unauthorised construction under sections 343 and 344 of the DMC Act. Similarly, the property bearing No.3206, Ranjit Nagar, New Delhi was also noted to be constructed without prior sanctioned building plan. Same is the position regarding the property bearing No.3207, Ranjit Nagar, New Delhi.

Another status report filed on 2.01.2020 states that on 09.07.2019 a demolition action was taken on the second floor of property No.3213, Ranjit Nagar, New Delhi. Photographs of the demolition have been placed on record.

The respondent/North DMC will continue to deal with the said properties as per law. Necessary steps to be taken within 12 weeks from today. After needful is done, report will be filed in court with an advance of the same to the learned counsel for the petitioner. With the above direction, the present writ petition is disposed of. All pending applications, if any, are also disposed of. JAYANT NATH, J.
