In furtherance of last order, arguments on maintainability partly heard. Basically, the objection from respondent side is that the petitioner, admittedly not having been a party before the trial court, cannot file the present petition under proviso to Section 25B(8) of the Delhi Rent Control Act in his independent capacity. The original tenant, according to the present respondent was Sh. Joginder Singh. The present petitioner Sh. Manjeet Singh is son of Joginder Singh. During pendency of the eviction proceedings, Sh. Joginder Singh passed away and was substituted with his legal representatives including Sh. Manjeet Singh. 2.
In the above backdrop, after part submissions, learned counsel for petitioner seeks permission to withdraw the present petition with liberty to institute appropriate legal proceedings before the court of competent jurisdiction.
