The defendant no.4/Mr. Mahender Kumar Aggarwal, who is one of the partners in the defendant no.1 firm, is present in Court today. He submits that he is representing the defendant no.1 firm as well as all the other partners/defendants no.2, 3 and 5. He submits through Mr. Naveen Kohar, Advocate appearing on behalf of the defendants that the defendants do not wish to contest the present case on merits and are willing to settle the present suit. He further submits that the defendants are willing to pay Rs.3 lakhs to the plaintiffs towards damages/costs.

Mr. Manish Biala, counsel appearing for the plaintiffs is agreeable to the same.

Accordingly, a decree of permanent injunction in terms of prayer clauses 47 (i) and (ii) is passed in favour of the plaintiffs and against the defendants. lakhs to the plaintiffs towards damages/costs within 30 days from today, failing which they will be liable to pay interest on the said amount @12% per annum.

In view of the above, counsel for the plaintiffs does not press for remaining reliefs in the plaint.

The suit is decreed in the aforesaid terms.

All pending applications stand disposed of.
